Ownership and Licenses
Olly Bowman retains ownership of all deliverables and materials developed pursuant to this Agreement (including, without limitation, all presentations, writings, ideas, concepts, designs, text, plans, and other materials that Olly Bowman conceives or develops in connection with Olly Bowman’s services for Client, including all materials incorporated therein whether such materials were conceived or created by Olly Bowman individually or jointly, on or off the premises of Client, or during or after working time), and Olly Bowman grants Client the license to use the work product in the following way(s) upon payment of all fees due to Olly Bowman pursuant to this Agreement:
– A worldwide, irrevocable, non-attribution license to use the work product for personal use only.
– The work product cannot be modified, have derivative works created from it, or be otherwise exploited in any way. This includes adding additional colouring or filters.
Right to Authorship Credit
When asked, Client must properly identify Olly Bowman as the creator of the deliverables. Client does not have a proactive duty to display Olly Bowman’s name together with the deliverables, but Client may not seek to mislead others that the deliverables were created by anyone other than Olly Bowman. Client agrees Olly Bowman may use the work product as part of Olly Bowman’s portfolio and websites, galleries and other media solely for the purpose of showcasing Olly Bowman’s work but not for any other purpose. Olly Bowman will not publish any confidential or non-public work without Client’s prior written consent.
